Right of Withdrawal Policy & Information

1. Scope of Application

This information applies to contracts concluded by consumers with AXEON TECHNOLOGIES (operator of the brand “TwinPeaks | trade + educate”) for digital content and digital services. The contractual partner is always AXEON TECHNOLOGIES. This includes, in particular, online courses, training content, software, software licenses or license keys for add-ons, indicators, and trading strategies (e.g., for NinjaTrader or ATAS), downloads, recordings, templates, as well as accompanying community, support, and live services.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

2. Right of Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

3. Premature Expiration of the Right of Withdrawal

Your right of withdrawal may expire before the 14-day period. We distinguish two cases:

a) Digital Content (e.g., downloads, license keys, recordings, templates)

For contracts concerning the supply of digital content not supplied on a tangible medium, your right of withdrawal also expires if we have begun the performance of the contract after you

have expressly consented to us beginning the performance of the contract before the expiry of the withdrawal period, and
have confirmed your knowledge that you lose your right of withdrawal by your consent when the performance of the contract begins, and
we have provided you with a confirmation of the contract in accordance with legal requirements.

b) Digital Services / Time-Limited Licenses (e.g., time-limited software licenses for NinjaTrader or ATAS add-ons, indicators, or strategies)

If it is a digital service or a time-limited provision (license period), your right of withdrawal expires if we have fully performed the service and have only begun performance after you

have expressly consented to us beginning performance before the expiry of the withdrawal period, and
have confirmed your knowledge that you lose your right of withdrawal by your consent upon full performance of the contract.

If you withdraw after performance has begun at your request, but before the service is fully rendered, you owe the proportionate compensation for the services already rendered, as described above under “Consequences of Withdrawal.”

4. What does this mean for you specifically?

Immediate Access: After purchase, you receive immediate access to the digital content or license and the respective customer area.
Express Request in Checkout: To enable immediate access, we obtain your express consent during the ordering process. With this consent, you request that we begin provision before the withdrawal period expires and confirm that you thereby lose your right of withdrawal in accordance with the aforementioned conditions.
Provision cannot be reversed: Once digital content has been provided – in particular downloads made available or license keys transmitted – it cannot be returned like physical goods.
